Speaker 0

Just before midnight in the Gui Dang neighborhood of Seoul, on 09/06/2005, 17 year old Han In-taek is starting his walk home.

Speaker 0

In-taek is a good kid.

Speaker 0

He had stayed late at his academy to study.

Speaker 0

And when he realized how late it was, he called his mom to let her know that he had missed the last bus at 11:42PM.

Speaker 0

But she doesn't need to come get him.

Speaker 0

He can walk the rest of the way to Gangnam Station and he will get home on his own.

Speaker 0

In-depth started the walk home, but the route home took him up a secluded dark hillside road, where he is stopped by two figures who emerge from the shadows.

Speaker 0

They are not there to talk to him.

Speaker 0

They don't even waste time threatening him.

Speaker 0

The attack is sudden and over quickly.

Speaker 0

There is no struggle as In-depth is caught off guard by the sudden violence.

Speaker 0

One of the attackers has stabbed him in the abdomen, piercing his aorta.

Speaker 0

It happened so quickly, he couldn't even scream.

Speaker 0

Medically speaking, when your aorta is severed, your blood pressure instantly tanks.

Speaker 0

It's not long before you lose consciousness.

Speaker 0

But In-taek goes into survival mode.

Speaker 0

Medical experts would describe his level of willpower as extraordinary.

Speaker 0

He managed to stay upright and reached into his pocket to pull out his cell phone and dial 112, which is the police line in Korea.

Speaker 0

The call lasted twenty seconds.

Speaker 0

For those twenty seconds, an emergency dispatcher listened to In-taek gasp for his final breaths.

Speaker 0

He no longer was able to get enough air to speak.

Speaker 0

However, in that twenty second call, when the police later replayed the audio, they swore they didn't just hear a plea for help.

Speaker 0

They heard a name.

Speaker 0

They said it was his dying message.

Speaker 0

And that one recording would set off a chain reaction of coerced confessions, contaminated witnesses, and a legal nightmare that would leave the killers free to walk the streets.

Warning.

Speaker 0

Today's episode discusses the death of a teenager with minor graphic description.

Speaker 0

Listener discretion is advised.

Speaker 0

The Hillside Road where In-taek was attacked wasn't just secluded and off the beaten path.

Speaker 0

It was a blind spot to anyone on the street and CCTV cameras as well.

Speaker 0

Despite being only 100 meters from a local police substation, which is just a small police office.

Speaker 0

The combination of the elevation of the hill and the lack of street lights made it pitch black.

Speaker 0

After In-taek collapsed on the dark road, the attackers didn't stick around.

Speaker 0

They ran back where they came from and disappeared before the emergency call had even connected.

Speaker 0

The geography of this land is pretty essential to understanding what happened.

Speaker 0

The neighborhood in 2005 had pretty heavy traffic from the nearby Gangneon Station.

Speaker 0

So there is a lot of foot traffic and cars because this road goes up a hill alongside a freeway.

Speaker 0

On one side of this hill is the Olympic Bridge across the Han River.

Speaker 0

Off the main roads was winding residential alleys.

Speaker 0

The specific route In-taek took that night was on a paved brick uphill path that was against a large hill, and on the right of it was a four lane highway, and on the left of it, between the brick path and the road, was a metal fence and a flower bed with trees and mostly just grass and leafy plants.

Speaker 0

So essentially, this is a brick paved sidewalk that goes up a hill and down below is the highway.

Speaker 0

In-taek wasn't entirely alone that night on the brick road.

Speaker 0

Besides the two attackers, as he started to turn to walk up the hill, a gas station employee identified as only Yoon saw In-taek walking.

Speaker 0

Yoon was finishing up unloading boxes from a delivery, but he watched In-taek because something just seemed off.

Speaker 0

In-taek was slowly walking and two figures that looked male were chasing him, but In-taek didn't notice.

Speaker 0

Yoon

Yun only kept watching because the men looked suspicious.

Speaker 0

According to Yun's initial account, the two people were walking quickly behind In-taek up the road.

Speaker 0

They weren't shouting or making any noise that he could hear.

Speaker 0

And a few minutes later, when Yun came back outside for more boxes, he looked back up the path and saw those two same people running back down the hill in the direction they came from.

Speaker 0

They were running like they were fleeing, not jogging, not late for an appointment running.

Speaker 0

They were sprinting for their lives.

Speaker 0

At the time, Yoon did not think he just witnessed a murder.

Speaker 0

He hadn't seen what happened when they caught up to In-taek.

Speaker 0

So he just assumed that this was some kind of bullying or maybe local delinquents getting into a fight.

Speaker 0

That's kind of what it seemed like to him.

Speaker 0

He didn't wanna involve himself and he didn't see the high schooler anymore.

Speaker 0

So he went back inside and finished his shift.

Speaker 0

About an hour after the two figures had caught up to In-depth at 1AM on September 7, two university students were walking home after a late night gaming session at a nearby Pixi Bang or a PC cafe.

Speaker 0

As they rounded the bend up the hill, they saw a person face down in the flowers on the side of the road.

Speaker 0

At first, they thought this was simply someone who had too much to drink and passed out on their way home.

Speaker 0

But when they got closer, they grew more worried.

Speaker 0

They noticed his school uniform and his Guangyang High School logo on his backpack.

Speaker 0

He was clutching his cell phone and looked sick.

Speaker 0

They worried he'd had a medical emergency, so they tried to shake him awake.

Speaker 0

That's when they noticed the blood on his clothes.

Speaker 0

They called the police.

Speaker 0

But wait, In-taek had already called the police.

Speaker 0

Right?

Speaker 0

So why hadn't the police just a 100 meters away?

Speaker 0

Why hadn't they arrived an hour later?

Speaker 0

Well, they didn't have his exact location because this is 2005, not modern day.

Speaker 0

His call wasn't still active and the dispatcher thought the call had been an accident.

Speaker 0

But they did still send out officers just in case to take a look at the area.

Speaker 0

The first officers who responded were driving through the area but didn't see anything because In-depth is in the foliage on the side of the sidewalk up a hill, where a car from the highway below wouldn't be able to see.

Speaker 0

So the officers chalked it up to a missed dial and just went back.

Speaker 0

For an hour, In-taek bled out internally, less than a 100 meters away from help.

Speaker 0

When the police arrived from the college students call, they didn't know what had happened to In-taek.

Speaker 0

Usually, when someone is stabbed in the abdomen, there is a large amount of blood, but he only had a very small amount of blood on his clothes and just a few droplets of blood on the ground.

Speaker 0

To these officers who weren't medical professionals, it did not look like a murder scene.

Speaker 0

This is because In-taek's injury had caused massive internal hemorrhaging.

Speaker 0

Forensic experts would later call this a surgical strike.

Speaker 0

Although they weren't trying to insinuate that the killer had surgical precision, but that the blade had gone through the muscle and sliced only his aorta.

Speaker 0

Initially, the police didn't believe this was the location he was stabbed because there was no blood on the ground or on his body.

Speaker 0

Medical experts believe that he died very quickly after being stabbed, meaning even if ambulances were called, it is unlikely he would have survived long enough to be saved.

Speaker 0

As the police continued to search the area, they found something just 90 meters away from his body.

Speaker 0

Up the hill, they found the knife that had been used to stab him tossed to the side of the sidewalk.

Speaker 0

There was no blood on the blade, and when they dusted it for prints, they found nothing.

Speaker 0

It appeared to be a brand new clean knife.

Speaker 0

In-taek didn't appear to have any defensive wounds as well, and nothing on his phone suggested he was involved in anything nefarious.

Speaker 0

Not to mention, nothing was stolen from him.

Speaker 0

Just as the gas station attendant had assumed, they also suspected that this had something to do with bullying.

Speaker 0

As the sun came up, the police were panicking.

Speaker 0

They're trying to figure out a way to explain how a high school student was stabbed to death within a 100 meters of a police station.

Speaker 0

They began by pulling the log of his 112 call recording.

Speaker 0

I'm going to play a segment of the audio for you now.

Speaker 0

You are going to hear the automated recording say 112, this is the police.

Speaker 0

And then a dispatcher answers and the woman will say, this is the police.

Speaker 0

Then after the victim makes some sound, she asks, hello?

Speaker 0

The audio is distressing, but it is only a few seconds long.

Speaker 0

So if you wanna skip ahead about fifteen seconds, you'll get past the audio.

Speaker 0

The police listened to this twenty second recording over and over and over, hoping to hear something besides him gasping for air.

Speaker 0

In the middle of the recording, one of the detectives stopped the tape and isolated a three second segment.

Speaker 0

He played it on a loop, just repeatedly.

Speaker 0

His colleagues couldn't hear what he was pointing out, but he swore he heard a name.

Speaker 0

He claimed to hear the name Gim.

Speaker 0

Now, if you listen to white noise long enough, your brain will start to find patterns.

Speaker 0

This is a psychological phenomenon called auditory pareidolia.

Speaker 0

As we humans have evolved to find speech even in poor conditions, like when it's a loud concert or a windy day, our brains try to fill in those blanks.

Speaker 0

Auditory paradolia is influenced by top down processing, meaning that if you expect to hear something, your brain will subconsciously warp what you're hearing to match that expectation.

Speaker 0

Once the detective decided he would hear a name in that recording, he did.

Speaker 0

Then every other officer who listened suddenly noticed it.

Speaker 0

You've likely seen ghost hunting shows where the host will play a recording of static in an empty room, and then a closed caption will label the sound as get out.

Speaker 0

Once that subtitle is on the screen, the audience suddenly hears it too.

Speaker 0

I'm not just accusing this officer of lying.

Speaker 0

He truly did believe he heard the name Gim, but I've told you that this case is riddled with coerced confessions, and this is why.

Speaker 0

When the case would eventually be reinvestigated in 2020 by private investigators, those investigators conducted a study by asking 20 people to listen to the recording.

Speaker 0

These people had never heard it before.

Speaker 0

None of them picked out a name in the sound.

Speaker 0

Then once they stopped and asked the participants, did you hear it?

Speaker 0

The victim is saying the name Gim.

Speaker 0

Then suddenly 16 out of the 20 people could hear it clear as day.

Speaker 0

This isn't trickery to make people look stupid or influence people to lie.

Speaker 0

No.

Speaker 0

It's our brains trying to find familiarity and patterns.

Speaker 0

But because this detective heard Gimp, they're now looking for someone with the last name Gimp.

Speaker 0

This wasn't going to narrow much down, but they believed that the attackers likely knew In-taek and that the attack was very personal.

Speaker 0

Kim is the most common surname in Korea though.

Speaker 0

They needed to narrow it down.

Speaker 0

So they started by looking into In-taek's social circle.

Speaker 0

They started by asking his friends and his teachers who does he spend time with.

Speaker 0

In-taek had two classmates who we will refer to by only their surnames, Kim and Jeong, which they are referred to as in the court documents as well.

Speaker 0

The detectives formed a theory that Kim and Jeong had a grudge against the victim.

Speaker 0

And this was a case of bullying that escalated into murder.

Speaker 0

Five days after the murder, Kim and Jeong were brought into the police station, but Kim and Jung weren't just questioned.

Speaker 0

They were immediately processed.

Speaker 0

During Kim's later testimony, he said that the police's behavior was intense.

Speaker 0

They were kicking the desk, screaming and shouting in his face, and threatening physical violence to keep him in a state of constant fear.

Speaker 0

The detectives did not ask their usual open ended questions as they should.

Speaker 0

They should allow the suspect to speak for themselves, But instead they presented Kim and Jung with a pre written story of what they thought happened and then started asking the boys, why did you do this?

Speaker 0

Why did you do that?

Speaker 0

They didn't ask them what they did.

Speaker 0

They told them what they did.

Speaker 0

The kicking desks and the chairs was to startle the boys and make them feel on edge.

Speaker 0

After hours of this, it turned to them forcing the boys to stand or sit in uncomfortable positions while shouting at them.

Speaker 0

The most famous and disturbing threat was that he told the boys, you're going to prison for at least four or five Olympics, meaning a life sentence, which he's threatening these 16 year old boys.

Speaker 0

The detectives then played the recording for the boys and lied to them.

Speaker 0

In-taek is naming you in this.

Speaker 0

He said your name as he died.

Speaker 0

There's no way out of this.

Speaker 0

There really was no tactic that the police were above.

Speaker 0

In a classic prisoner's dilemma, they told Kim and Jeong that the other had confessed and named the other as the one who had actually wielded the knife and stabbed In-taek.

Speaker 0

They did this as a means to pressure the other to spill everything.

Speaker 0

They told them to tell the truth while pushing forward that pre made story.

Speaker 0

They kept insinuating if they just told the story like the police had predicted, they'd get a lighter sentence.

Speaker 0

Psychological pressure is an effective tool, especially against children who are susceptible to it.

Speaker 0

To a 16 year old boy trapped in a room of aggressive adults for hours on end, the truth just becomes whatever makes it all stop.

Speaker 0

And at no point were lawyers brought in or their parents contacted.

Speaker 0

They threatened the boys that if they didn't confess quickly, they'd arrest their parents as well as accomplices for helping them hide the crime.

Speaker 0

This interrogation would break anyone, not to mention two 16 year old boys.

Speaker 0

Under exhaustion, Kim eventually broke first.

Speaker 0

He started to just blindly agree to whatever the police said.

Speaker 0

This led to a confession that was impossible.

Speaker 0

Actually, like forensically impossible.

Speaker 0

Gim described that he brought a switchblade with him just to intimidate In-taek.

Speaker 0

And then they got into a long fist fight.

Speaker 0

He got a few good punches in on In-tech before it escalated, and he stabbed In-tech to end the fight.

Speaker 0

But we already know.

Speaker 0

In-taek

In-tech had no defensive wounds.

Speaker 0

He had one stab wound in the abdomen and no bruising.

Speaker 0

And the knife that was found at the scene, not a switchblade, but the police didn't care about the details.

Speaker 0

Not at all.

Speaker 0

They took the boys to the Hillside Path for the crime reenactment immediately.

Speaker 0

And there, the detectives closely held the boys and whispered in their ears what to do.

Speaker 0

This would later be pointed out as the detectives guiding them and telling them what had happened at the crime scene.

Speaker 0

The boys at multiple moments pointed the wrong direction.

Speaker 0

They mimic stabbing incorrectly.

Speaker 0

That's not where he was stabbed.

Speaker 0

No, you need to do it this way.

Speaker 0

And then the police would correct the actions until the boys accurately matched that premade story.

Speaker 0

They chalked it up to it being dark when they committed the crime and that the boys couldn't see well, and they're so young, so they don't remember.

Speaker 0

The case moved on to its only eyewitness, Yoon, the gas station attendant.

Speaker 0

The police didn't show Yun a lineup of eight or more similar looking people to Zhang and Kim.

Speaker 0

没有。

No.

Speaker 0

They brought Kim and Zhang to the gas station after the reenactment.

Speaker 0

Just brought them right down the hill in handcuffs and asked Yun, are these the boys you saw chasing In-taek?

Speaker 0

They already confessed.

Speaker 0

Not only is memory such an unreliable thing, but now that he's seen these boys in handcuffs, this completely overrides his original memory.

Speaker 0

Anyone would now only see those boys' faces.

Speaker 0

You'd imagine them running up the hill and you'd believe the police when they said they had a confession.

Speaker 0

So he said yes.

Speaker 0

By the time the case reached the courtroom in 2006, the Guangdong Police Department believed they had an open and shut case.

Speaker 0

They had a confession from Kim, the recording, a secondary confession from Zhang, and an eyewitness.

Speaker 0

But the moment the case moved forward, it all began to fall apart.

Speaker 0

The defense for Kim and Zhang immediately went on the offensive and pointed at the coerced confessions.

Speaker 0

The moment the boys were away from the Kwonjin detectives and in front of a judge, they testified that they only confessed because they thought the police would kill them or kill their parents if they didn't.

Speaker 0

But it wasn't just the coercion that bothered the court.

Speaker 0

Honestly, that should have ended the trial then and there, but it was actually the inconsistencies in the confessions that the judge was focusing on.

Speaker 0

As I mentioned earlier, Gim's confession described a long fight and the use of a switchblade.

Speaker 0

The prosecution tried to argue that the knife found 90 meters away was close enough to a switchblade for a 16 year old to misidentify.

Speaker 0

Maybe the 16 year old had only heard the term switchblade in movies and didn't actually know what it was, which I find very hard to believe.

Speaker 0

But the medical examiner's report couldn't be misinterpreted like that.

Speaker 0

There were no bruises on In-depth face, no bruises on his knuckles, no torn clothing.

Speaker 0

The fight just didn't happen.

Speaker 0

Then came the issue of physical evidence or actually the lack of physical evidence.

Speaker 0

In a case involving a stabbing, you would expect to find some DNA, especially if a 16 year old was the one who had done it.

Speaker 0

DNA on the knife from the attacker gripping it so tightly, maybe even blood on the attacker's clothing.

Speaker 0

But they had nothing.

Speaker 0

They hadn't found a single drop of Intex blood on either of the boys' clothing, even though they were arrested just five days later.

Speaker 0

The knife was also pristine.

Speaker 0

Not even a partial smudge of a fingerprint was found on the handle.

Speaker 0

The attacker clearly wore gloves, which neither of the boys had mentioned wearing.

Speaker 0

As the trial dragged on and wasted time, the prosecution's star witness, Yoon, began to question his own memory.

Speaker 0

Under cross examination, the truth about the one man lineup came out, and this is not standard procedure.

Speaker 0

Yoon admitted that on the night of the murder, it was so dark, he could really only see silhouettes of two young men chasing In-taek.

Speaker 0

He confessed that he only said yes to these boys were the ones he saw because the police had said they'd already confessed.

Speaker 0

While the trial continued, a secondary tragedy was happening just outside of the courtroom.

Speaker 0

In-taek

In-taek's father had been battling a brain tumor when his son was murdered.

Speaker 0

The stress of losing his son was only worsened by hearing that the police were ruining any chance of finding justice for his son.

Speaker 0

He spent his final months listening to the police fail his son and tragically, he died shortly before the verdict was reached.

Speaker 0

He died without knowing who killed his son and without ever seeing justice served.

Speaker 0

It was late two thousand six when the Supreme Court of South Korea issued its final ruling.

Speaker 0

They found the boys not guilty due to a lack of evidence.

Speaker 0

And this is highly unusual, but in this case, the Supreme Court justices actually criticized the investigation.

Speaker 0

They ruled that the confessions were highly likely to have been coerced, and that the one one two recording was too ambiguous to be used as evidence.

Speaker 0

Kim and Zhang were acquitted, but they'd just spent a year of their high school years fighting, being falsely accused of murder of their classmate.

Speaker 0

I cannot imagine that their lives returned normal after this.

Speaker 0

In the eyes of the law, acquittal means that the case is closed.

Speaker 0

The system had solved whether or not Kim and Zhang had actually done it.

Speaker 0

But now, of course, they weren't going to go back and look for the two who actually had murdered In-taek.

Speaker 0

They didn't look for the two people that Yun had actually seen.

Speaker 0

Instead, the police authorized the destruction of all physical evidence.

Speaker 0

The knife, the victim's clothing, the forensic swabs.

Speaker 0

It was all sent to the police's incinerator.

Speaker 0

For fifteen years, the murder of In-taek was considered a closed case.

Speaker 0

It was a case that simply did not end in a conviction, but Han In-taek's mother never gave up.

Speaker 0

She was convinced that the acquitted students were actually the true killers, a belief supported by the original detectives who continued to insist that In-taek had named Gim on the tape.

Speaker 0

In 2020, the investigative program, Unanswered Questions, they decided to reopen the case.

Speaker 0

They didn't just look at the testimony.

Speaker 0

They wanted to use modern technology to finally find an answer to the question that started this entire nightmare.

Speaker 0

What was actually on that twenty second recording?

Speaker 0

I'm gonna replay it for you here.

Speaker 0

The production team and investigators took the original audio to the Voice Analysis Institute and handed it over to the director, Lee Chul Hyun.

Speaker 0

He is one of South Korea's leading forensic audio experts.

Speaker 0

Director Lee approached the audio without an expectation and performed a frequency analysis.

Speaker 0

The results destroyed the original police deduction that In-taek had said Gim's name.

Speaker 0

Director E determined that the specific sound segment the original detective had identified as the name Gim wasn't human speech at all.

Speaker 0

Instead, the frequency matched a groan of pain, which makes sense.

Speaker 0

In-depth was suffering from an aortic rupture, which severed the largest artery that carries oxygen throughout the body.

Speaker 0

He was groaning in pain due to a condition called air hunger.

Speaker 0

Your body becomes so desperate for oxygen, but your lungs just cannot maintain the pressure necessary to make articulate sounds.

Speaker 0

You become unable to speak when this happens, especially sounds like the letter k.

Speaker 0

And I'm gonna sound like the English teacher I am, but this is a plosive sound produced by stopping air in the back of the mouth with a voiceless stop and then sudden burst of air.

Speaker 0

In-taek

In-taek would not have been able to make this sound.

Speaker 0

According to the 2020 forensic reanalysis, In-taek was not spending his final breath naming a classmate.

Speaker 0

He was actually trying to plead for medical help, but he wasn't speaking in the way we understand it.

Speaker 0

He was desperately trying to push air through a throat that was closing, forcing out vowel heavy fragments of a sentence.

Speaker 0

Experts believe that he was trying to say I've just been stabbed with a knife.

Speaker 0

But it wouldn't have come out this way.

Speaker 0

更可能听起来像是几个元音反复重复,比如 e、i、i、i、i。

It might have sounded closer to just the vowels like e, I, I, I, I.

Speaker 0

This would have been known if the police had taken the audio recording to an analyst in the first place.

Speaker 0

Even ten years prior, it likely would have been decipherable by a voice analysis expert or even just a linguist.

Speaker 0

And then Kim and Zhang wouldn't have had a year of their lives ruined and they might have caught the culprit.

Speaker 0

But if it wasn't the students, then were there any other leads for who had done this?

Speaker 0

When the 2020 investigators started looking into the creepy men that Yuan had seen, they found a lead that had been just sitting since 2005.

Speaker 0

At the time of the murder, a tip had come in about a group of older delinquents, not students, but young adults in their early twenties who are known to frequent that specific area.

Speaker 0

These men were not bullies.

Speaker 0

They were petty thieves.

Speaker 0

They were known to carry knives and target people who walked home alone at night.

Speaker 0

And the police knew this.

Speaker 0

This fits the crime exactly.

Speaker 0

And then they discovered something else.

Speaker 0

After witness Yun gave his initial statement to the police in 2005, he himself was targeted by this local gang.

Speaker 0

Shortly after the suspects were arrested, Yun was physically assaulted by unknown assailants.

Speaker 0

During the assault, his attackers allegedly said, now you won't be able to testify.

Speaker 0

This strongly suggested that the real killers were not only still in the neighborhood, but they were actively monitoring the investigation and had intimidated a witness.

Speaker 0

This might have also been a reason he falsely identified the two teenage boys as the killers.

Speaker 0

If the police had looked into this local gang of delinquents, they likely would have known them from previous crimes.

Speaker 0

But because the Guangdong police had heard the name on the tape, they never followed up on the assault against Yun.

Speaker 0

They never looked into the professional delinquent groups.

Speaker 0

They never even looked into the local delinquent groups.

Speaker 0

They stayed tunnel visioned while the trail went cold.

Speaker 0

Today, the murder of In-taek remains unsolved.

Speaker 0

The statute of limitations for murder has thankfully been abolished since 2015, but without any of the original evidence, there is nothing left to test.

Speaker 0

Han In-taek used his final twenty seconds to try and save himself, and the police he called failed to keep him safe.

Speaker 0

The same police targeted, harassed, and coerced two innocent boys into confessing.

Speaker 0

And then they let the real killers get away with it.

Speaker 0

After everything, I think the most important question is not only who truly killed Han In-taek, but also how did an investigation move so confidently in the wrong direction?

Speaker 0

Because in this case, the mistake wasn't just that bad interrogation, just the misheard sound on the audio recording.

Speaker 0

No.

Speaker 0

It was just a huge chain, a domino effect of bad decisions that kept just reinforcing the one before it until the investigation was operating under a completely fictional story they sold themselves.

Speaker 0

The police believe they heard the name Gim in that call.

Speaker 0

And from that moment forward, the case began narrowing around that belief.

Speaker 0

They looked for a Gim.

Speaker 0

They built the entire case around the name Gim.

Speaker 0

They misinterpreted the boy's fear as guilt, and any contradictions in the case, they just ignored.

Speaker 0

Keith Findley and Michael Scott, who are two criminologists and legal scholars, they call this investigative tunnel vision.

Speaker 0

Those involved in the case focus on one suspect.

Speaker 0

They select and filter evidence that fits their case and ignore or suppress evidence that goes against what they want to be true.

Speaker 0

This kind of tunnel vision, I fear, is very common in many aspects of life.

Speaker 0

Importantly, though, tunnel vision doesn't always mean corruption or intentional change.

Speaker 0

It can just begin with ordinary reasoning.

Speaker 0

Confirmation bias makes us just more likely to notice information that supports what we already believe and dismiss information that challenges it.

Speaker 0

But in a criminal investigation, confirmation bias is very dangerous, because the police officer's private opinions might just decide whose freedom matters, whose memory is trustworthy, and which leads end up being followed.

Speaker 0

In In-taek's case, the evidence didn't point to Kim and Jeong being guilty.

Speaker 0

When the high school student, Kim, was finally pressured into confessing, after hours of physical intimidation, he told a story that completely contradicted the evidence they already had.

Speaker 0

The confession described a fight, a switchblade, of which neither fit the actual crime.

Speaker 0

But tunnel vision means the police were willing to say, maybe we just misinterpreted the original evidence and then try to make it fit.

Speaker 0

It wasn't a find out what happened.

Speaker 0

At this point, it was make it fit.

Speaker 0

And then there was Yoon, the gas station employee who was a contaminated witness.

Speaker 0

I wanna clarify, there was a little bit of witness tampering and witness contamination, but the witness tampering, which is an effort to influence, intimidate, or prevent a witness from testifying, that was from the local gang who likely were the ones actually behind this crime.

Speaker 0

The witness contamination, which is the unintentional or intentional altering of a witness's memory through suggestive questioning or hearing other people's testimonies, which affects their credibility as a witness, that was done by the police.

Speaker 0

Memory is a fickle thing and it's incredibly open to suggestion.

Speaker 0

Yoon did see something important that night.

Speaker 0

He saw In-taek walking casually and two figures chasing him up the dark road.

Speaker 0

Later, he saw the same figures running back down the hill.

Speaker 0

He didn't see any faces, only that they appeared to be teenage boys to adult men.

Speaker 0

He did not see the murder.

Speaker 0

He just saw the figures and kind of felt the vibe of the body language, which suggested he believed a fight was going to happen.

Speaker 0

That original memory matters because it was likely the most accurate account of what happened that night, but it would be changed over time.

Speaker 0

Eyewitness researchers have warned for decades that identification evidence is highly vulnerable to police procedures.

Speaker 0

The problem is not that witnesses are stupid or malicious.

Speaker 0

The problem is that our memories are not recordings.

Speaker 0

As much as we want to be impartial, our memories are not.

Speaker 0

Our memories are a reconstruction within our minds of what we believe happened.

Speaker 0

Memories can be changed by suggestion, pressure, repetition, and authority.

Speaker 0

The 1998 scientific white paper, which is a report that uses evidence based research to explain an issue, this report done by Gary Wells, who is a professor of psychology, was looking into how certain lineup methods are especially likely to produce false identifications, and that these system variables are under the control of the criminal justice system.

Speaker 0

In other words, some eyewitness mistakes are not unpredictable.

Speaker 0

They happen because we have bad legal practices.

Speaker 0

In a normal lineup, witnesses are often shown several people at once, which encourages them to make comparison between the people.

Speaker 0

It asks the question, who looks the most like the person you saw?

Speaker 0

But Wells found that this can be very suggestive.

Speaker 0

The witness might choose the closest looking person, even if the real offender is not there.

Speaker 0

In contrast, sequential lineups where people are shown one at a time forces the witness to ask a different question.

Speaker 0

Is this the person I saw?

Speaker 0

Yes or no.

Speaker 0

The point of his research wasn't that people are dishonest, but that our mind fills in the gaps and molds our memory to fit the choices we are given.

Speaker 0

What happened with Yoon was against procedure as well.

Speaker 0

The lineup of many people is pretty standard, but the police didn't even do that.

Speaker 0

They didn't give him any choices.

Speaker 0

They presented Kim and Zhang in front of him in handcuffs and asked, is this them?

Speaker 0

By that point, Yoon was no longer able to retrieve his original memory.

Speaker 0

He was being asked to confirm the police's arrest.

Speaker 0

And once the police told him the boys had already confessed, his uncertainty had to go against their authority.

Speaker 0

Of course, his memory shifted from this.

Speaker 0

He imagined the boys running up the hill, but keep in mind, he had also been threatened by the gang to shut up.

Speaker 0

By the time Yoon testified in court, he admitted that the night had been just too dark to clearly identify the two people, and that he only said yes because the police told him the boys had already confessed.

Speaker 0

We don't know if he truly didn't see the two boys because at this point he had been threatened.

We also need to talk about procedural justice, which has been on my mind a lot lately, but in this case, it's perfect for me to ramble about.

Speaker 0

Procedural justice is a theory developed by Tom Tyler, an expert in the field of criminology.

Speaker 0

He says that people judge the legitimacy of the law not just by the outcome or sentencing, but by whether the process of justice feels fair, respectful, and trustworthy.

Speaker 0

People are more likely to cooperate with legal authorities when they believe the authorities are legitimate.

Speaker 0

That is not meaning that they have power, but that they have trust and confidence in the police.

Speaker 0

In this case, there's very little trust and confidence in the authorities.

Speaker 0

In-tech called for the police less than a 100 yards from the police station and wasn't found in time.

Speaker 0

02:16 year old boys were interrogated under pressure without their parents, without the protections that children are guaranteed by law.

Speaker 0

The only witness was shown suspects in handcuffs and told about the confessions that were coerced.

Speaker 0

Then contradictory evidence was ignored.

Speaker 0

And then after all of this, after the trial concluded and the Supreme Court found the boys not guilty, the evidence was then destroyed rather than store it.

Speaker 0

Procedural justice matters because the justice system's purpose isn't just to punish people.

Speaker 0

It also has to be trusted to help those who are harmed.

Speaker 0

In-taek's family deserved an honest investigation that found justice for In-taek.

Speaker 0

Kim and Dong deserve to be treated as innocent until proven guilty.

Speaker 0

I think it's also important that the public is informed when the police make mistakes such as these and that there is actionable plan created to prevent it from happening again.

Speaker 0

If the legal system does not serve the people, then we will never have justice.

Speaker 0

We must be given a reason to believe that the authorities are public servants rather than just enforcers of the state.
