Now, not everybody's, some, you know, but if you know what you're doing, if you know the federal rules, if you show respect for the court, if you submit excellent quality written work, you never misquote a case, you never misrepresent the state of the facts, you'll do very well with Judge Kaplan.

First order of business was selecting a jury.

Kaplan quickly lived up to his no nonsense reputation.

Often jury selection can take days, but not on his watch.

And to Judge Kaplan's credit, he was remarkably efficient in selecting a jury.

And obviously this case presented a number of issues that would have made jury selection in other courts very difficult, but he got right down to business and picked a jury in probably about three hours.

We thought it would take probably three or four days.

As we've discussed previously, Keller and Skolnick are big fans of jury trials.

But weren't they concerned that New Yorkers would already be prejudiced against Spacey, even though they'd weeded out jurors who already had opinions about the case.

Also, Manhattanites are notoriously liberal, which could mean they were inclined to go along with the believe all victims mindset.

Most people associate him with evil characters.

I worked as a federal public defender in the Eastern District Of New York, so I was familiar with the jury pool.

And New Yorkers are savvy, right?

So we felt we had a pretty good shot here at a fair jury because the case was so strong for us and the evidence was so overwhelming that Mr.

Spacey was innocent that we felt an intelligent, educated jury that Manhattan could provide would be good for us.

The trial began, and any idea that Rapp or his legal team might be chastened by their apparently crumbling case was quickly dispelled.

My name is Peter Segier, and I represent Anthony Rapp, who is seated at the corner of our table.

To understand the nature of this case and what has happened and why we have brought this case, there are certain things that you need to know upfront.

As you have heard, we are going to be talking about events that happened many years ago, over thirty five years ago, in 1986, when Anthony was just 14 years old.

What happened to Anthony is something that never should have happened, something that was wrong and, quite frankly, unacceptable.

Segere told the jury that there could be no doubt Anthony Rapp was just a child when he and John Baramond met Kevin Spacey after a matinee performance of A Long Day's Journey Into Night.

He walks down from 81st Street in York, down 2nd Avenue to the sixties, and he arrives at the building.

Anthony goes upstairs to the apartment.

Then Segier tells the jury about the alleged assault by Kevin Spacey on a 14 year old boy.

Despite all the evidence to the contrary that Spacey and his team compiled, Segiers still maintains the apartment had a separate bedroom.

Kevin Spacey walks over to Anthony sitting on the bed.

Anthony does not recall any words spoken, but Kevin Spacey comes up to Anthony as he's seated at the edge of the bed, and he takes one arm and puts it behind Anthony's back.

And then with his other hand, he puts it under Anthony's butt.

Segier tells the jury that shortly after the incident, Rapp left New York, went back to Joliet, and told a friend what had happened.
